Neognathae product terms

Neognathae, including the Kestrel text classifier, is a product family of Auxerta, Inc. These terms apply when incorporated into an accepted product agreement (the “Agreement”). The Agreement identifies the contracting entity and authorized access. AI data and evaluation services supplied by Auxerta, LLC remain subject to a separate service agreement.

Access is limited to the model, version, purpose, deployment method, authorized users, usage limits, and term specified in the Agreement. Evaluation access confers no production or redistribution rights unless expressly granted. Source code, model weights, and training data are excluded unless expressly licensed. No license arises by implication from a publication, demonstration, or research result.

You represent that you hold the rights, permissions, and lawful authority necessary to supply input data. Processing of inputs and outputs is subject to the confidentiality, purpose, and data-protection provisions of the Agreement. Authorization to provide model access does not confer a right to use your inputs for unrelated training.

Classification labels and confidence information may be incomplete or erroneous. You remain responsible for validation criteria, review of outputs, and authorization of downstream actions. Reported accuracy is limited to the disclosed test conditions and does not constitute a representation or warranty of performance in another deployment, except as expressly provided in the Agreement.

Auxerta and its licensors retain all rights in the supplied models, software, documentation, and product marks. You shall not bypass access controls, disclose access credentials to unauthorized persons, redistribute restricted materials, or use the product unlawfully. Ownership and licenses concerning inputs, outputs, fine-tunes, and commissioned artifacts are governed by the Agreement. No assignment is implied by access or delivery.

Availability, support, warranties, liability, termination, governing law, and dispute resolution are governed by the executed product agreement and applicable law. No service level, refund rule, or liability cap is created by a research note or Website illustration. Any material change to an existing agreement must follow its amendment process.
